Data protection regulations and Conditions of participation for Contests via Instagram
Our competitions are in no way connected to Instagram and are in no way organized or supported by Instagram. The organizer of the competitions is PetVet GmbH, Reichsstraße 78, 58840 Plettenberg.
Eligibility to participate
Anyone over the age of 18 who is resident in Germany, Austria or Switzerland and has their own Instagram account is eligible to take part in the PetVet GmbH competition on Instagram. Participation with fake identities or with identities of third parties is not permitted. Employees of PetVet GmbH and their relatives as well as employees of the companies involved in this competition and their relatives are excluded from participation. PetVet GmbH reserves the right to exclude participants who violate the conditions of participation from the competition. Participation in the competition takes place exclusively within the framework of these conditions of participation. By participating in the promotion, the conditions of participation are accepted.
Closing date
The closing date and the competition period are stated in the respective entry.
Participation
Every participant who fulfills the conditions of participation stated in the post (comment on the post and/or like the post/send message/story repost etc.) will be entered into the prize draw.
Copyright and granting of rights
The participant assures that he/she holds all rights to the submitted image, has the unrestricted exploitation rights to all parts of the image, that the image is free of third-party rights and that no personal rights are violated in the depiction of persons. If one or more persons are recognizably depicted in the picture, the persons concerned must agree to the picture being published. Should third parties nevertheless assert claims for infringement of their rights, the participant shall indemnify the organizer against all claims.
The participant irrevocably grants PetVet GmbH the right, unlimited in time and space, to use the submitted image in the context of and in connection with the competition, its implementation and in media communication about it.
PetVet GmbH reserves the right to delete images that contain or depict insults, racism and hate propaganda, pornography and obscenities, calls for violence against persons, institutions or companies.
Prize and prize draw
The content of the prize will be described in the respective competition post.
The winners will be selected at random from all participants by the PetVet GmbH social media team after the closing date and will be contacted by direct message and asked to provide their full contact details and address. The prize draw will be carried out using the Comment Picker tool (https://commentpicker.com/). By participating in the competition, participants agree to the prize draw via Comment Picker. If the winner has not responded to the prize notification via private message after four days, he/she loses the right to the prize and a replacement winner will be chosen. The prize will be sent to the winner by post.
Only one prize is possible per winner. The prize will be distributed via PetVet GmbH, a third party commissioned by PetVet GmbH or a cooperation partner of PetVet GmbH. The participants' data may be passed on to the aforementioned partners for the purpose of distributing the prize. The data will only be used to carry out the competition and will then be deleted. The purchase of products or the use of services from PetVet GmbH is not a prerequisite for participation in the competition and has no influence on the outcome of the competition itself. The prize is neither transferable nor can it be exchanged. A cash payment is excluded.
Liability
PetVet GmbH is released from all obligations when the prize is handed over to the participant.
PetVet GmbH is not liable for material defects and/or defects of title in the prizes. PetVet GmbH shall not be liable for the insolvency of a cooperation partner or the resulting consequences for the execution and handling of the competition.
PetVet GmbH shall only be liable for damages caused by PetVet GmbH or one of its vicarious agents intentionally or through gross negligence or through the breach of cardinal obligations. This limitation of liability does not apply to damages resulting from injury to life, body and/or health.
Furthermore, PetVet GmbH is not liable for damages resulting from the impairment of the availability of the competition website in the event of technical faults and force majeure events beyond its control, as well as attacks by third parties against the competition website. However, PetVet GmbH will make every effort to ensure the reliability and functionality of the competition website. Furthermore, PetVet GmbH does not guarantee that the competition website will function properly on the respective participant's device.
Privacy policy for competitions
PetVet GmbH Reichsstraße 78, 58840 Plettenberg, Germany, is responsible for the collection of personal data in the context of the competition.
The data transmitted by the participants with their participation will only be stored for the purpose of conducting the competition and handling the competition. Data will only be passed on to third parties if this is necessary to carry out the competition or with the consent of the participant.
Participants consent to their name (Instagram handle) being published on the Instagram page (story or feed post) of PetVet GmbH (@pha_petvet) if they win.
If PetVet GmbH processes your personal data, you as the data subject are entitled to the rights set out in our general privacy policy (https://petvet-gmbh.de/datenschutz/) under the data protection law requirements (right of access, right to rectification, right to erasure, right to restriction of processing; right to information, right to data portability, right to object; right to withdraw the declaration of consent under data protection law, right to lodge a complaint with a supervisory authority).
Miscellaneous
PetVet GmbH reserves the right to change these conditions of participation and/or the prize at any time and without giving reasons. The competition is subject to the law of the Federal Republic of Germany. Legal recourse is excluded.
